HOUSE CONCURRENT
RESOLUTION
REQUESTING THE PROHIBITION OF COMMERCIAL AND TOUR FLIGHTS OVER KUNIA, Oahu.
WHEREAS, the provision of commercial and tour aircraft flights has been successful for some private companies; and
WHEREAS, these aircraft have, however, become a bane to many residents of areas over which the aircraft fly; and
WHEREAS, operators often fly these aircraft over the same areas and neighborhoods on a daily basis, to the detriment of residents and visitors below, who experience constant noise; and
WHEREAS, due to the distress and disruption caused by the chronic noise, aircraft noise has become a public health concern; and
WHEREAS, residents of Kunia, Oahu have been particularly affected by this problem; and
WHEREAS, the State is preempted by federal law from enacting laws to prohibit the flight of aircraft over any location; now, therefore,
BE IT RESOLVED by the House of Representatives of the Thirty-second Legislature of the State of Hawaii, Regular Session of 2023, the Senate concurring, that the Federal Aviation Administration is requested to prohibit commercial and tour flights over Kunia, Oahu; and
BE IT FURTHER RESOLVED that the Federal Aviation Administration is requested to seek from Congress the prohibition requested by this measure, if the authority to establish the prohibition has not yet been granted to the Federal Aviation Administration; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Administrator of the Federal Aviation Administration, Majority Leader of the United States Senate, Speaker of the United States House of Representatives, and members of Hawaii's congressional delegation.
