HOUSE CONCURRENT

RESOLUTION

REQUESTING that THE HAWAII TOURISM AUTHORITY, in coordination with THE DEPARTMENT OF LAND AND NATURAL RESOURCES, conduct a STUDY on THE issues related to CLOTHING-OPTIONAL BEACHES in the state.

WHEREAS, many tour books and travel guides list certain secluded beaches in Hawaii as being clothing-optional, but few contain any disclaimers or warnings regarding the legality of nudity on state beaches; and

WHEREAS, certain websites, including TripSavvy and Huffington Post, include lists of clothing-optional beaches that are located on all of the major Hawaiian islands; and

WHEREAS, the beaches listed on these websites include Kehena Beach and Honokohau Harbor Beach on the island of Hawaii; Donkey Beach and Kauapea Beach, also known as Secret Beach, on Kauai; Little Beach and Kaihalulu Beach, also known as Red Sand Beach, on Maui; Papohaku Beach on Molokai; and Polo Beach and Kahuku Beach on Oahu; and

WHEREAS, clothing-optional beaches are typically secluded, requiring walking long distances or hiking on steep trails to access them; and

WHEREAS, there are multiple issues concerning these clothing-optional beaches, including the possibility of unsuspecting tourists being arrested for public nudity, sanitation concerns caused by the lack of restrooms, and safety concerns caused by the fact that these beaches have neither reliable cell-phone reception nor call boxes; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the Senate concurring, that the Hawaii Tourism Authority, in coordination with the Department of Land and Natural Resources, is requested to:

(1) Conduct a study on the issues related to clothing-optional beaches in the State; and

(2) Provide recommendations to promote Hawaii as a tourist-friendly destination that also protects the health and safety of tourists seeking clothing-optional beaches; and

BE IT FURTHER RESOLVED that the Hawaii Tourism Authority is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2019; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the President and Chief Executive Officer of the Hawaii Tourism Authority, the Chairperson of the Hawaii Tourism Authority Board of Directors, and the Chairperson of the Board of Land and Natural Resources.
