HOUSE CONCURRENT
RESOLUTION
urgING the united states CONGRESS TO AMEND TITLE 49 CODE OF FEDERAL REGULATIONS SECTION 383.3 TO ALLOW BOTH ACTIVE AND FORMER MILITARY PERSONNEL TO OBTAIN COMMERCIAL DRIVER'S LICENSES.
WHEREAS, veterans who have acquired skills while serving in the military may qualify for civilian employment requiring similar skills and experience in the private sector; and
WHEREAS, the State of Hawaii appreciates individuals who have served our nation and recommends that military personnel who wish to obtain a commercial driver's license be able to do so for up to one year after honorable discharge if they have complied with current federal regulations for obtaining a commercial driver's license; and
WHEREAS, supporting the transition of veterans from active military status to non-active status is in the best interest of Hawaii's economy; and
WHEREAS, Title 49 Code of Federal Regulations section 383.73 provides that states must require that commercial driver's license applicants comply with federal application and testing processes; and
WHEREAS, putting the State of Hawaii out of compliance with federal regulations would deter the State's ability to gain access to federal funding; and
WHEREAS, Title 49 Code of Federal Regulations section 383.3 exempts active military personnel from the federal application and testing requirements, but does not exempt former military personnel; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the Senate concurring, that the United States Congress is urged to direct appropriate federal agencies to amend Title 49 Code of Federal Regulations section 383.3 to include both active military and former military personnel in its exemption from commercial driver's license application and testing requirements; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Majority Leader of the United States Senate, the Speaker of the United States House of Representatives, each member of Hawaii's congressional delegation, the Governor, the Speaker of the House of Representatives, the President of the Senate, the Adjutant General, and the Director of the Office of Veterans' Services.
