HOUSE CONCURRENT
RESOLUTION
REQUESTING THE DEPARTMENT OF TRANSPORTATION TO CONVENE A WORKING GROUP TO EVALUATE THE EFFECTS OF PROHIBITING TRUCKS WITH A GROSS VEHICLE WEIGHT OF TEN THOUSAND POUNDS OR MORE FROM USING THE LEFT-MOST LANE ON CERTAIN HIGHWAYS.
WHEREAS, heavier trucks that are driving slower than the speed of traffic can contribute to traffic congestion on highways, especially if there are trucks in every lane; and
WHEREAS, the left-most lane on a highway is typically designated as a passing lane; and
WHEREAS, several states, including California, Connecticut, Georgia, Indiana, Michigan, and New Jersey, have enacted laws referred to as left-lane restrictions, which prohibit larger motor vehicles from using the left-most lane on highways with three or more lanes except to pass or turn left; and
WHEREAS, there have been studies showing benefits to left-lane restrictions, such as increased average traffic speeds, though some studies have found negative consequences, such as an increase in accidents; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the Senate concurring, that the Department of Transportation is requested to convene a working group to evaluate the effects of prohibiting trucks with a gross vehicle weight of ten thousand pounds or more from using the left-most lane on certain highways and any impacts it has on traffic congestion and safety; and
BE IT FURTHER RESOLVED that the working group is requested to include in the evaluation an analysis of other states that have similar left-lane restrictions and how those laws affect traffic congestion and safety; and
BE IT FURTHER RESOLVED that the working group is requested to compare the effects of a full-time left-lane restriction and a left-lane restriction that is only applicable during peak commuting times; and
BE IT FURTHER RESOLVED that the Director of Transportation is requested to serve as the Chair of the working group and to invite participation by two representatives from the Hawaii Transit Authority; and
BE IT FURTHER RESOLVED that the working group is requested to submit a report of its findings and recommendations to the Legislature no later than twenty days before the convening of the Regular Session of 2019; and
BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Transportation.
