HOUSE CONCURRENT
RESOLUTION
REQUESTING THE CONVENING OF A TASK FORCE TO ASSESS THE SCOPE AND FEASIBILITY OF ESTABLISHING A STATEWIDE SYSTEM OR PROTOCOL IN WHICH ADVANCE CARE PLANNING FORMS CAN BE ACCESSED BY ALL HEALTH FACILITIES.
WHEREAS, advance care planning forms such as a health care power of attorney, provider's orders for life-sustaining treatment, and advance health care directives are important documents that ensure individual health care wishes are honored by medical professionals; and
WHEREAS, it is critical that advance care planning forms be readily and quickly available to medical staff; and
WHEREAS, medical care is not always provided by a patient's established primary care provider due to emergency or unforeseen circumstances; and
WHEREAS, a statewide system or protocol for advance care planning forms would allow all health facilities in the State to have immediate access to patients' health care wishes; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2015, the Senate concurring, that the Director of Health is requested to convene a task force to assess the scope and feasibility of establishing a statewide system or protocol in which advance care planning forms can be accessed by all health facilities; and
BE IT FURTHER RESOLVED that the task force focus on a statewide system or protocol for documents including an individual's health care power of attorney, provider's orders for life-sustaining treatment, advance health care directives, and any other form the Director of Health deems relevant; and
BE IT FURTHER RESOLVED that the Director of Health or the Director's designee serve as the chairperson of the task force; and
BE IT FURTHER RESOLVED that the Director of Health or the Director's designee choose the members of the task force; provided that the members include or represent hospitals, health care facilities, nursing homes, an attorney experienced in hospital administration, the University of Hawaii Elder Law Program, and any other entities the Director deems appropriate; and
BE IT FURTHER RESOLVED that the task force submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2016; and
BE IT FURTHER RESOLVED that the task force be dissolved on June 30, 2017; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Health and Director of the University of Hawaii Elder Law Program.
