HOUSE CONCURRENT

RESOLUTION

 

 

AUTHORIZING THE ISSUANCE OF A TERM, NON-EXCLUSIVE EASEMENT COVERING A PORTION OF STATE SUBMERGED LANDS AT KUKUIULA, KOLOA, KONA, KAUAI, FOR A SEAWALL AND STEPS, AND FOR USE, REPAIR, AND MAINTENANCE OF THE EXISTING IMPROVEMENTS CONSTRUCTED THEREON.

 

 

 

WHEREAS, portions of a seawall and steps fronting property identified as Tax Key No.: (4) 2-6-11:019 at Kukuiula, Koloa, Kona, Kauai, are located makai of the shoreline; and

 

WHEREAS, Edmund Donald Gregoire and Linda Lee Gregoire acquired the property by deed dated December 24, 2014, and thereafter learned of the encroachment of the seawall and steps; and

 

WHEREAS, in approximately the fall of 2015, the Gregoires began to work with the Department of Land and Natural Resources to resolve the encroachment; and

 

WHEREAS, on September 23, 2016, under Agenda Item D-1, the Board of Land and Natural Resources approved the grant of a non­exclusive easement for a term of fifty-five years to run with the land and to inure to the benefit of the abutting property, to resolve the encroachment; and

 

WHEREAS, the term, non-exclusive easement covering one-hundred six square feet was appraised at a fair market value of $7,820.00; and

 

WHEREAS, section 171-53, Hawaii Revised Statutes, requires the prior approval of the Governor and prior authorization of the Legislature by concurrent resolution to lease state submerged lands; now, therefore,

 

BE IT RESOLVED by the House of Representatives of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, the Senate concurring, that the Board of Land and Natural Resources is hereby authorized to grant a term, non-exclusive easement covering a portion of state submerged lands fronting the property identified as Tax Key No.: (4) 2-6-11:019, makai of the property at Kukuiula, Koloa, Kona, Hawaii, for the seawall and steps, and for use, repair, and maintenance of the existing improvements constructed thereon pursuant to section 171-53, Hawaii Revised Statutes; and

 

BE IT FURTHER RESOLVED that a certified copy of this

Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
