HOUSE RESOLUTION
REQUESTING AN AUDIT OF THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY'S METHOD AND PROCESS FOR DETERMINING IMPACT ON AND ADEQUACY OF INFRASTRUCTURE FACILITIES FOR DEVELOPMENT PROJECTS IN A COMMUNITY DEVELOPMENT DISTRICT AND THE ROLE OF THE CITY AND COUNTY OF HONOLULU IN THAT DETERMINATION.
WHEREAS, the Legislature established the Hawaii Community Development Authority in 1976 as a public entity with responsibility for, among other things, designing and planning community development programs in cooperation with private enterprise and federal, state, and county governments that result in communities that serve the highest needs and aspirations of Hawaii's people; and
WHEREAS, to ensure that a comprehensive and coordinated plan is executed with and for the community, the Authority conducts, or requires a developer to conduct, an assessment of existing and proposed infrastructure including roadway, water, and sewer capacity to determine whether it is or will be adequate to support the proposed development project; and
WHEREAS, this infrastructure assessment is mandatory for development projects in the Kakaako Community Development District under the Authority's rules requiring project eligibility reviews for all development in the Kakaako Makai area; and
WHEREAS, the ordinances of the City and County of Honolulu require that the Department of Planning and Permitting determine that adequate public facilities and utilities will be provided at the time of occupancy as a condition for approving and issuing required permits for any new development project; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-seventh Legislature of the State of Hawaii, Regular Session of 2014, that the Auditor is requested to perform an audit of the Hawaii Community Development Authority's method and process for determining the adequacy of infrastructure for development projects in its review of development project applications. This shall include the City and County of Honolulu's role in that method and process; and
BE IT FURTHER RESOLVED that, as part of the audit, the Auditor is requested to investigate the following:
(1) The Authority's process for the formulation of development plans, including revisions and amendments to master plans with respect to infrastructure including roadway, water, and sewer capacity;
(2) The manner in which the Authority and the City and County gather and assess information on the location and capacity of existing infrastructure;
(3) The manner in which the Authority and the City and County gather and assess information on the location and projected capacity of proposed new infrastructure; and
(4) The manner in which the Authority and the City and County impose and enforce requirements to construct, modify, or maintain infrastructure to ensure adequacy for new development within a Community Development District; and
BE IT FURTHER RESOLVED that the Auditor is requested to submit a report of findings, recommendations, and proposed legislation, if any, to the Legislature no later than 20 days prior to the convening of the Regular Session of 2015; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Auditor, the Executive Director of the Hawaii Community Development Authority, and the Director of Planning and Permitting of the City and County of Honolulu.
