A BILL FOR AN ACT

 

 

relating to time share plans.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that there is a growing problem with the intrusion of time share projects and fractional ownership of residential units in single family and multi-family residential zones.  This intrusion, with its increase in traffic, off-street parking demands, noise, and other negative effects, alters the fabric of neighborhoods.  These time share projects and fractional ownerships in residential neighborhoods also have the deleterious effect of increasing the market prices of residential units artificially, thereby negatively impacting longtime residents by increasing real property tax assessments.

     The purpose of this Act is to restrict time share and fractional ownership.

     SECTION 2.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-     Limitations on time share units and fractional ownership.  Each county shall adopt ordinances prohibiting time share units or fractional ownership of single family, duplex, or multi-family units in zones other than hotel zones or resort destination areas.

     For purposes of this section:

     "Time share units" shall have the same meaning as section 514E-1.

     "Fractional ownership" means the ownership of a fee or leasehold interest in a single family, duplex, or multi-family unit by three or more persons who are not related by blood, marriage, or legal adoption."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
