A BILL FOR AN ACT

 

 

RELATING TO THE DEPARTMENT OF LAND AND NATURAL RESOURCES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature reaffirms that the invasion of Hawaii by insects, disease-bearing organisms, snakes, weeds, and other pests is the single greatest threat to Hawaii's economy and natural environment and to the health and lifestyle of Hawaii's people.  The legislature finds that action is needed to improve the State's programs to mitigate the threats and impacts of invasive species and to effectively implement the Hawaii interagency biosecurity plan.

     The legislature recognizes the Hawaii interagency biosecurity plan as the primary guiding document for improving invasive species prevention, detection, and control capacity over the ten-year scope of the plan, from 2017 to 2027.

     The purpose of this Act is to enhance protection of Hawaii's natural resources, agriculture, human health, and way of life by appropriating funds for those portions of the Hawaii interagency biosecurity plan that can be implemented in the 2019-2021 fiscal biennium.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 for ten full-time equivalent positions (10.0 FTE) for the department of land and natural resources division of forestry and wildlife to respond to invasive species in Hawaii's protected forests and wildlife sanctuaries (LNR402).

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $972,000 or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 for the Hawaii invasive species council to support research and interagency projects (LNR402).

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $500,000 or so much thereof as may be necessary for fiscal year 2019-2020 and the same sum or so much thereof as may be necessary for fiscal year 2020-2021 for rapid ōhia death response (LNR402).

     SECTION 5.  The director of finance is authorized to issue general obligation bonds in the sum of $           or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2019-2020 for the purposes of capital improvement projects for Maliko gulch, Maui (LNR402), to construct a coqui frog barrier fence and various requests for fencing to exclude invasive animals from protected areas.

     SECTION 6.  The appropriation made for the capital improvement project authorized by section 5 of this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2022, shall lapse as of that date.

     SECTION 7.  The sums appropriated in sections 2, 3, and 4 shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 8.  The sum appropriated for the capital project set forth in section 5 shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 9.  This Act shall take effect on July 1, 2050.
