A BILL FOR AN ACT

 

 

RELATING TO DRUG TESTING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-     Drug testing.  In order to retain eligibility, all recipients of general assistance, food stamps, or temporary assistance for needy families administered by the department are subject to drug testing if there is reasonable suspicion to believe that the recipient, while receiving assistance, has consumed a controlled substance.  The department may terminate benefits for any recipient who refuses to consent to a drug test, or to any recipient who fails a drug test by testing positive for a controlled substance.  The department shall adopt rules under chapter 91 as necessary to effectuate this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
