A BILL FOR AN ACT
RELATING TO MOTOR VEHICLES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
PART I
SECTION 1. Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§291C- Operation of a motor vehicle near a bicycle prohibited. The driver of a motor vehicle shall not operate the motor vehicle within one yard of a person operating a bicycle."
PART II
SECTION 2. There is appropriated out of the state highway fund established pursuant to section 248-8, Hawaii Revised Statutes, the sum of $ or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 for a grant-in-aid to the department of transportation services of the city and county of Honolulu to operate a van pool program on the island of Oahu; provided that:
(1) The city and county of Honolulu department of transportation services shall submit to the state department of transportation and legislature a plan for the use of the grant-in-aid before any expenditure or obligation is made for the van pool program. The plan shall be submitted at least thirty days prior to the city and county of Honolulu department of transportation services expending or obligating any portion of the grant-in-aid; and
(2) The city and county of Honolulu department of transportation services shall submit two reports to the state department of transportation and legislature on the use of the grant-in-aid with statistics on expenditure, usage, benefits, and costs. The first report shall cover the period from July to December 2015 and shall be submitted prior to the convening of the regular session of 2016. The second report shall cover fiscal year 2016-2017 and shall be submitted at least twenty days prior to the convening of the regular session of 2018.
The sums appropriated shall be expended by the department of transportation for the purposes of this Act.
PART III
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2050.
