(2) Establish
priorities in determining eligibility in the event that insufficient funds are
available to fund otherwise qualified applicants; [and]
(3) Give preference to
all qualified businesses receiving their first award in one fiscal year over
multiple award grantees[.]; and
(4) Require
businesses receiving an award to reimburse the State all moneys awarded in the
event that the company relocates its principal place of business out of Hawaii
within five years of receiving an award.
The development corporation may adopt any other rules pursuant to chapter 91 necessary for the purposes of this section."
SECTION 3. There is appropriated out of the general
revenues of the State of Hawaii the sum of
$ or so much
thereof as may be necessary for fiscal year 2019-2020 and the same sum or so
much thereof as may be necessary for fiscal year 2020-2021 for the continuance of the small business innovation research program;
provided that the Hawaii technology development corporation shall plan to
provide funds for phase three grants where applicable.
The sums appropriated shall be expended by the Hawaii technology development corporation for the purposes of this Act.
SECTION 4. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
