A BILL FOR AN ACT
RELATING TO EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"SECTION 1. (a)
The department of health may require the department of education
[shall publish a weekly] to report on [schools that have a
student, staff member, or affiliated individual who has tested positive for]
coronavirus disease 2019 [(COVID-19).
The report shall include:
(1) The school's name;
(2) The date the COVID-19 positive test result
was reported to the school; and
(3) The date that the positively tested
individual was last on the school campus.
(b) The report shall
be published weekly commencing after July 1, 2021, on the department of
education's website.] potential
outbreaks or other public health emergencies and related information in a
manner most appropriate to public health and safety, as determined by the
department of health. (b)
The department of health shall not require the department of education
to include in any report personally identifiable information or education
records, as provided in title 20 United States Code section 1232g and title 34
Code of Federal Regulations section 99.3; provided that the department of
education may provide personally identifiable information only after it has
determined that a health or safety emergency exists."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 3000.
Report Title:
DOH; DOE; Report; COVID-19; Schools; Family Educational Rights and Privacy Act; Personally Identifiable Information
Description:
Authorizes the Department of Health to require the Department of Education to report coronavirus disease 2019 potential outbreaks or other public health emergencies and related information in a manner most appropriate to public health and safety, as determined by the Department of Health. Repeals the requirement to publish the report on the Department of Education's website. Prohibits the Department of Health from requiring the Department of Education to provide personally identifiable information in any report pursuant to the federal Family Educational Rights and Privacy Act. Authorizes the Department of Education to provide personally identifiable information only after it has determined that a health or safety emergency exists. Effective 7/1/3000. (HD1)
