A BILL FOR AN ACT

 

 

RELATING TO MEDICAL RESIDENCY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that doctors in medical residency programs in Hawaii are not allowed to practice outside of the hospitals in which they are serving their residencies.  However, if the estimated several hundred medical residents in Hawaii were allowed to practice within the scope of their residency training in settings outside of their hospitals, they would provide a convenient and ready pool to ease the shortage of medical practitioners in Hawaii, particularly on the neighbor islands.

     The purpose of this Act is to bring more licensed physicians into the physician community to increase access to health care.

     SECTION 2.  Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§453‑    Medical residents practice of medicine outside of medical residency program hospital or clinic.  (a)  A person licensed under this chapter who is a medical resident serving in a medical residency program in a hospital or clinic in this State may engage in the practice of medicine outside of that hospital or clinic.

     (b)  Any contractual restriction or prohibition that prohibits the practice of medicine as specifically allowed by subsection (a) shall be deemed void as a matter of law.

     (c)  As used in this section, the term "medical residency program" refers to graduate medical training.  A medical resident is a person who has received a medical degree and who practices medicine in a medical residency program under the supervision of fully licensed physicians, usually in a hospital or clinic.  A medical residency may follow the internship year or include the internship year as the first year of residency."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
