A BILL FOR AN ACT

 

 

RELATING TO THE State parks special fund.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to:

     (1)  Require a portion of the moneys deposited into the state parks special fund to be allocated to the department of land and natural resources and office of planning and sustainable development based on the percentage of residents who have a favorable perception towards Hawaii's tourism industry as reported in the most recent Hawaii Tourism Authority resident sentiment survey results; and

     (2)  Increases the sum to be appropriated out of the state parks special fund for fiscal year 2022-2023 by $12,000,000, to be expanded by the department of land and natural resources in conjunction with the office of planning and sustainable development.

     SECTION 2.  Section 184-3.4, Hawaii Revised Statutes, is amended to read as follows:

     "§184-3.4  State parks special fund.  (a)  There is established within the state treasury a fund to be known as the state parks special fund, into which shall be deposited all proceeds collected by the state parks programs involving park user fees, any leases or concession agreements, the sale of any article purchased from the department to benefit the state parks programs, or any gifts or contributions; provided that proceeds derived from the operation of Iolani Palace shall be used to supplement its educational and interpretive programs.

     (b)  Except for proceeds derived from the operation of Iolani Palace collected pursuant to subsection (a) and moneys deposited into the Diamond Head State Monument sub-account pursuant to subsection (e), remaining proceeds collected and deposited into the state parks special fund pursuant to this section shall be distributed as follows:

     (1)  A percentage of the deposited proceeds equal to the percentage of resident sentiment survey respondents who responded with a rating of six or higher on the issue of "Perception of tourism industry in Hawaii – Favorability" in the most recent resident sentiment survey result published by the Hawaii tourism authority shall be allocated to the department; and

     (2)  The remainder of the deposited proceeds shall be allocated to the office of planning and sustainable development.

     [(b)] (c)  The department shall expend [the] moneys received from the state parks special fund for the following purposes:

     (1)  Permanent and temporary staff positions;

     (2)  Planning and development of state parks programs, including the aina hoomalu state parks program;

     (3)  Construction, repairs, replacement, additions, and extensions of state parks facilities;

     (4)  Operation and maintenance costs of state parks and state parks programs; and

     (5)  Administrative costs of the division of state parks.

     (d)  The office of planning and sustainable development shall expend moneys received from the state parks special fund for the planning and development of sustainable state parks.

     [(c)] (e)  There is established within the state parks special fund, a Diamond Head State Monument sub-account, into which shall be deposited fifty-five per cent of all proceeds collected from the admission fees charged at the Diamond Head State Monument.  The department shall expend the moneys from the Diamond Head State Monument sub-account for repair, maintenance, and operating costs incurred by the State in the management of the Diamond Head State Monument."

     SECTION 3.  There is appropriated out of the state parks special fund the sum of $15,094,536 or so much thereof as may be necessary for fiscal year 2022-2023 for the department of land and natural resources, in conjunction with the office of planning and sustainable development, for the administration of the state parks program and planning and development of sustainable state parks, pursuant to section 184‑3.4, Hawaii Revised Statutes.

     The sum appropriated shall be expended by the department of land and natural resources, in conjunction with the office of planning and sustainable development, for the purposes of this Act.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.


     SECTION 5.  This Act shall take effect on July 1, 2022.
