A BILL FOR AN ACT
relating to Department of Education facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part VI, subpart C, to be appropriately designated and to read as follows:
"§302A- Asset preservation program. (a) There is established within
the school facilities authority an asset preservation program. The purpose of the asset preservation program shall be to require the department to maintain
facilities through a uniform program of specifications, standards, and
requirements to ensure performance accountability, promote student health and
safety by maintaining and operating building systems to their design capacity,
maintain an encouraging learning environment, and extend building life.
(b) The board shall adopt rules pursuant to
chapter 91 for uniform specifications, standards, and requirements for the
maintenance of facilities. The rules
shall also include a scoring system to be used in the facility condition
assessment to help evaluate and compare the condition of facilities.
(c) Each year, the school facilities authority
shall perform a facility condition assessment on each facility. The facility condition assessment shall
include a score calculated according to the rules adopted by the board and a
determination of whether the facility has been maintained as required by the
rules adopted by the board. The facility
condition assessments shall be submitted to the board and superintendent no
later than June 30 of each year. The board
and superintendent shall review the facility condition assessments to verify
whether each facility is being properly maintained and to determine whether
additional funding for repairs or maintenance is necessary.
(d) Once every five years, each facility shall be evaluated
by a certified evaluator approved by the department of accounting and general
services. The certified evaluator shall perform
a facility condition evaluation and report the condition to the board and superintendent. The board and superintendent shall compare
the facility condition evaluation with the previous facility condition
assessments for consistency and to determine future repair and maintenance. The timing of facility condition evaluations shall
be staggered so that approximately one-fifth of all facilities are evaluated
each year.
(e) All facility condition assessments and facility condition evaluations shall be accessible to the public on the department's website."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
