A BILL FOR AN ACT
relating to best practices for building code administration.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds professionally trained building code officials, inspectors, and permit counter staff are assets to facilitating a consistent and efficient regulatory permitting process. The legislature also finds that periodic retrospective review of permit applications, review processes, and methods of approval can result in more resilient and sustainable buildings, help increase affordable housing options, and enhance our state economy to the benefit of all Hawaii's citizens. The legislature further finds action is needed to assist governmental entities to employ resources or organizational tools and to identify and implement best practices at the building code permitting agencies to address persistent barriers to affordability as identified in the "Report of the Governor's Affordable Housing Regulatory Barriers Task Force", December 2008, which states, "In the context of building homes that are affordable, government regulations often work against developing an affordable product".
The purpose of this Act is to establish the building permit agency best-practices grant program within the Hawaii state building code council to provide the counties with matching funds to seek building permit agency best-practices accreditation or building department accreditation from the International Accreditation Service, either of which involves peer evaluation of current practices against nationally developed best practices so any identified shortcomings can be effectively bridged.
SECTION 2. Chapter 107, Hawaii Revised Statutes, is amended by adding two new sections to part II to be appropriately designated and to read as follows:
"§107-
Building permit agency
best-practices grant program; established.
(a) There is established
within the council the building permit agency best-practices grant
program. The building permit agency
best-practices grant program shall assist the counties by providing matching
grant funds to the counties to finance the associated costs of seeking building
permit agency accreditation or building department accreditation through the International
Accreditation Service.
(b) The building permit agency best-practices
grant program shall provide matching grant funds to each county in an amount
equal to the amount allocated by the county for the purposes set forth in
subsection (a), which may include funds donated privately by businesses or
associations for the purposes set forth in subsection (a) and in-kind employee
hours; provided that no more than $25,000 shall be provided to any specific
county.
(c) The council shall adopt rules, pursuant to
chapter 92 and exempt from chapter 91, to effectuate this section.
§107-
Building permit agency
best-practices grant program special fund; established. There is established in the state
treasury the building permit agency best-practices grant program special fund
to be administered by the council and into which shall be deposited
appropriations made by the legislature. Moneys
in the special fund shall be used to provide matching grant funds under the
building permit agency best-practices grant program."
SECTION 3. There
is appropriated out of the general revenues of the State of Hawaii the sum of
$100,000 or so much thereof as may be necessary for fiscal year 2018-2019 to be
deposited into the building permit agency best-practices grant program special
fund.
SECTION 4. There
is appropriated out of the building permit agency best-practices grant program
special fund the sum of $100,000 or so much thereof as may be necessary for
fiscal year 2018-2019 for the building permit agency best-practices grant
program.
The sum appropriated shall be expended by
the state building code council for the purposes of this Act.
SECTION 5. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2018.
