A BILL FOR AN ACT

 

 

RELATING TO AUDIT OF ELECTIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 23, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§23-    Audit of elections.  Following each statewide general election, the auditor shall conduct an audit of the general, special, and primary election immediately preceding the general election.  In the case of a special election not held in conjunction with a primary or general election, the audit shall be conducted immediately after the special election has concluded.  The audit shall include an examination of the following:

     (1)  The performance of the elections process, addressing among other things, security, reliability, and verifiability issues related to electronic voting machines, computer software and hardware, the accuracy of the vote count, voting procedures, and the conduct of the election;

     (2)  The operations of the office of elections, including management, as related to accuracy of the election;

     (3)  Budget; and

     (4)  Procurement.

The auditor shall report to the legislature on findings and recommendations no later than one hundred and twenty days following each general election."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2010-2011 for the auditor to conduct audits of elections.

     The sum appropriated shall be expended by the auditor for the purposes of this Act.

SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval, and shall apply to all elections occurring after July 1, 2010.
