A BILL FOR AN ACT
RELATING TO THE DEPARTMENT OF TRANSPORTATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§266- Ocean
transport containers; weight. (a)
Notwithstanding any other provisions of this chapter, the department of
transportation may weigh any ocean transport container that is offloaded at a
harbor in the State and fine any company that transports to the State an ocean
transport container having a gross weight over
.
(b) The department of transportation shall adopt
rules pursuant to chapter 91 to effectuate the purposes and enforce the
requirements of this section, including rules to establish fines; provided that
any fine imposed pursuant to this section shall be based on the amount by which
the gross weight of the ocean transport container exceeds the gross weight
limit provided in subsection (a).
(c) As used in this section, "ocean
transport container" shall have the same meaning as in title 23 United
States Code section 127(c)."
SECTION 2.
This Act does not affect rights and duties that matured, penalties that
were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 3000.
