A BILL FOR AN ACT

 

 

RELATING TO Motor Carriers.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the United States Department of Transportation, effective June 30, 2009, requires owners of intrastate commercial motor vehicles to have and display an intrastate United States Department of Transportation number on their vehicles, in addition to any interstate United States Department of Transportation number.

     The legislature further finds that the new requirements for obtaining an intrastate Department of Transportation number may be causing confusion for owners of commercial vehicles that are registered with a United States Department of Transportation number for interstate commerce.  As a result, these truckers are encountering difficulty entering the State's harbors to load goods onto ships in interstate commerce for shipping to the mainland.

     The purpose of this Act is to clarify that an owner of a commercial motor vehicle having a United States Department of Transportation number for interstate commerce as required by the United States Department of Transportation shall be allowed to enter harbors of the State for the purpose of transportation of goods interstate.

SECTION 2.  Chapter 266, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§266‑    Shipments of goods in interstate commerce; DOT number.  Any commercial motor vehicle having a United States Department of Transportation number for interstate commerce shall be allowed to enter a commercial harbor under the jurisdiction of the department of transportation under section 266-1 for the purpose of transporting goods, animals, or produce destined for interstate commerce.  The department of transportation shall not require a commercial motor vehicle under this section to obtain a United States Department of Transportation number for intrastate commerce."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
