A BILL FOR AN ACT

 

 

RELATING TO game BIRD HUNTING IN THE MAUNA KEA WATERSHED.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that within the Mauna Kea conservation district live a number of rare, threatened, or endangered plants, animals, and arthropods found nowhere else on the planet.  Among those protected birds are the palila (Loxioides bailleui).  Approximately ninety-six per cent of the entire palila population lives on the southwestern slope of Mauna Kea where the widest and most intact belt of māmane forest exists.  Palila survival relies on the māmane-naio forest itself.

     The Endangered Species Act of 1973 protects palila by prohibiting the "unlawful taking" of these birds.  The legislature finds that unlawful taking includes causing injury to, or the death of the palila whether with intent or negligence.  In order to prevent the accidental harm to palila, the type of firearms and ammunition used in the hunting of game birds, in the palila's habitat on Mauna Kea, must be restricted.

     The purpose of this Act is to require that game bird hunters who use firearms for hunting may only use single shot long guns or rifles while hunting in the palila's protected area of the Mauna Kea watershed.

     SECTION 2.  Chapter 183D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§183D-    Mauna Kea watershed; firearms and ammunition restrictions.  No person hunting within the area comprising lands known or referred to as the Mauna Kea conservation district, Mauna Kea watershed, the southwestern slopes of Mauna Kea, or any hunting area within one hundred meters in or around the base of Mauna Kea shall use or cause to be used a firearm other than a single shot long gun or rifle in the hunting of game birds.  The applicable area of this prohibition specifically includes the Kaohe game management and restoration area."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
