A BILL FOR AN ACT

 

 

relating to domestic animals.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 142, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

     "§142-    Domestic animals; rules.  The department of agriculture shall adopt rules pursuant to chapter 91 regarding the care of domestic animals.  The rules shall apply to any person who owns, possesses, controls, or otherwise has charge or custody of a domestic animal.  The rules shall address, at minimum, the following as they relate to domestic animals:

     (1)  Regular exercise;

     (2)  Sufficient food and clean water;

     (3)  Sufficient housing or shelter;

     (4)  Sufficient space for movement;

     (5)  Sufficient veterinary care;

     (6)  A microchip implanted under the skin, if applicable and upon the consent of the owner; and

     (7)  Reasonable restrictions on tethering of the domestic animal, if applicable."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
