A BILL FOR AN ACT

 

 

Relating to Handicap Parking.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 291-59, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§291-59[]]  Enforcement.  (a)  Notwithstanding any law to the contrary, and in addition to any other authority provided by law that is not inconsistent with the purposes of this part:

     (1)  A law enforcement officer may access the property of a private entity to enforce the provisions of this part; and

     (2)  A commissioned volunteer enforcement officer may access the property of a private entity during normal business hours of the entity to enforce the provisions of this part;

provided that the private entity's parking lot contains a parking space reserved for persons with disabilities.

     (b)  Hawaii law enforcement officers in good standing, whether on or off duty, may enforce traffic infractions under this part."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
