A BILL FOR AN ACT
RELATING TO MINIMUM WAGES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that Hawaii's current minimum wage of $7.25 per hour is equal to the federally mandated minimum wage which is woefully inadequate when considering Hawaii's highest in the nation cost of living. According to the National Conference of State Legislatures, as of August, 2009, the following states had a higher minimum wage than Hawaii: California, $8.00; Colorado, $7.28; Connecticut, $8.00; District of Columbia, $8.25; Illinois, $8.00; Massachusetts, $8.00; Michigan, $7.40; Nevada, $7.55; New Mexico $7.50; Ohio, $7.30; Oregon, $8.40; Rhode Island $7.40; Vermont, $8.06; and Washington, $8.55.
The legislature further finds that an increase of fifty cents in Hawaii's minimum wage is still inadequate to enable workers to keep abreast of the cost of living, but an increase in that amount is a start in the right direction to help ease the burden on Hawaii's families.
The purpose of this Act is to increase the State's minimum wage.
SECTION 2. Section 387-2, Hawaii Revised Statutes, is amended to read as follows:
"§387-2 Minimum wages. Except as provided in section 387‑9 and this section, every employer shall pay to each employee employed by the employer, wages at the rate of not less than:
(1) $6.25 per hour beginning January 1, 2003;
(2) $6.75 per hour beginning January 1, 2006; [and]
(3) $7.25 per hour beginning January 1, 2007[.];
and
(4) $7.75 per hour beginning January 1, 2011.
The hourly wage of a tipped employee may be deemed to be increased on account of tips if the employee is paid not less than 25 cents below the applicable minimum wage by the employee's employer and the combined amount the employee receives from the employee's employer and in tips is at least 50 cents more than the applicable minimum wage."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
