A BILL FOR AN ACT

 

 

RELATED TO PUBLIC PARKS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Limitations.  No county shall prohibit leashed dogs in public parks."

     SECTION 2.  Chapter 339, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§339-    Dog excrement; prohibition.  No person shall leave dog excrement on any public or private property or in any public or private waters, except:

     (1)  In a place designated by the department or the county for the disposal of garbage, dog excrement, and refuse;

     (2)  Into a litter receptacle; or

     (3)  Into a bag; provided that the bag is disposed of properly into a litter receptacle or in a place designated by the department or the county for the disposal of garbage, dog excrement, and refuse."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.

Description:

Prohibits counties from prohibiting leashed dogs in public parks.  Prohibits persons from leaving dog excrement on public or private property.  (SD1)
