STATE OF HAWAII

A BILL FOR AN ACT

 

 

RELATING TO WATER QUALITY MANAGEMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  (a)  There is established the water quality task force to address the water crisis caused by the Red Hill underground bulk fuel storage facility fuel leak.  The water quality task force shall be composed of the following members:

     (1)  One member from the commission on water resource management, who shall serve as co-chair;

     (2)  One member from the department of health, who shall serve as co-chair;

     (3)  One member from the city and county of Honolulu board of water supply;

     (4)  One member from the department of business, economic development, and tourism;

     (5)  One member from the University of Hawaii;

     (6)  One member from the senate;

     (7)  One member from the house of representatives;

     (8)  One member from the city and county of Honolulu, who shall be invited to participate by the co-chairs;

     (9)  One member from the Environmental Protection Agency, who shall be invited to participate by the co-chairs;

    (10)  One member from the United States Geological Survey, who shall be invited to participate by the co-chairs; and

    (11)  Two members of the public, who shall be invited to participate by the co-chairs.

     (b)  The members of the task force shall serve without compensation, but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.  No member shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation as a member of that task force.

     SECTION 2.  The water quality task force shall conduct a comprehensive study to examine the consequences of the water crisis caused by the Red Hill underground bulk fuel storage facility fuel leak, including:

     (1)  Environmental impacts on water quality;

     (2)  Infrastructure to support water quality management;

     (3)  Water quality impacts on public health;

     (4)  Economic impacts from water quality; and

     (5)  A wastewater reuse study for the purpose of responding to water scarcity caused by water rationing from the Red Hill underground bulk fuel storage facility fuel leak.

     The study shall include a recommendation plan, including a plan to handle water rationing on Oahu.

     SECTION 3.  This task force is deemed necessary to qualify for federal aid financing or reimbursement.

     SECTION 4.  The water quality task force shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2024.

     SECTION 5.  The water quality task force shall dissolve on June 30, 2024.

     SECTION 6.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 for a multi-year study, to be completed in 2023, to investigate the consequences of the Red Hill underground bulk fuel storage fuel leak and the subsequent impacts to the environment, infrastructure, public health, and the economy.

     The sum appropriated shall be expended by the department of land and natural resources for the commission on water resource management for the purposes of this Act.

     SECTION 7.  This Act shall take effect on July 1, 2022.

Description:

Establishes a task force to investigate the environmental, infrastructure, public health, and economic consequences of the Red Hill water crisis and include a recommendation plan that also considers water rationing.  Appropriates funds.  (SD1)
