A BILL FOR AN ACT
relating to ENERGY EFFICIENCY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 196, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§196- Use of motion sensor technology in state facilities. (a) No building permit shall be issued for any new construction, major renovation, or retrofit of a facility that does not include the use of motion sensor technology.
(b) The department of accounting and general services shall adopt rules pursuant to chapter 91 to implement this section.
(c) For the purpose of this section:
"Major renovation" means any significant altering in any way of one or more facilities or structural components of a facility; and
"Motion sensor technology" means technology that uses motion sensor devices or other technology to automatically control a building's lighting, heating, ventilation, and air conditioning systems based on the presence or absence of people."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2011.
