A BILL FOR AN ACT

 

 

RELATING TO THE state office of CAPITAL IMPROVEMENTs.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that in order to build and maintain a strong economic foundation and thriving business conditions, the State must build and maintain a strong infrastructure and state facilities.  Adequate investment in infrastructure and facilities is crucial to combat the effects of a recession and to realize positive growth in the future.  The State, in concert with the federal government, has supported efforts to maintain and even increase dedicated funding for capital improvement program projects throughout the State, in order to stimulate the economy and provide for the creation of jobs, especially in a down economy.

     As part of the State's capital improvement program, each department identifies the need for new facilities, major renovations, major permanent repairs, and other improvements that are necessary to reduce or eliminate safety hazards or respond to emergencies.  Currently, the need for capital improvements throughout the departments is unbalanced, with many departments having little or no capital improvement needs.  Therefore, some departments have larger staffs dedicated to work on the department's capital improvement program, while others may have few or no positions for such purpose.  Furthermore, on a state level, there is no specialized office to oversee all capital improvement program projects.

     The legislature finds that the increased focus and importance of investing in necessary infrastructure and facilities in the State has spurred the need to appropriately track and maintain comprehensive and detailed information on the State's capital improvement program.  This need has been highlighted through the administration's recent CIP strikeforce initiative to expedite $1.8 billion of projects.  A component of the initiative includes a provision for transparency regarding the projects.  However, the lack of dedicated staff for the sole purpose of tracking and overseeing the initiative's projects has resulted in a lack of meaningful transparency and instead produced information that is difficult to comprehend and utilize.

     The purpose of this Act is to establish the state office of capital improvements to improve the way projects are delivered and completed in the State, as well as provide oversight, monitoring, evaluation, and reporting on the progress of the capital improvement program of the State.  This Act also establishes the state capital improvements special fund to provide for operating and other expenses of the state office of capital improvements.

     SECTION 2.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

state office of capital improvements

     §   ‑1  State office of capital improvements; established.  There is established within the department of budget and finance, the state office of capital improvements to serve as a centralized project delivery office and to provide oversight, monitoring, evaluation, and reporting on the progress of the capital improvement program of the State.

          §   ‑2  Executive director and staff.  (a)  The head of the state office of capital improvements shall be known as the executive director of capital improvements.  The executive director shall have experience in finance, business, law, or other related fields.  The executive director shall be appointed by the governor without regard to chapters 76 and 89, and shall be compensated at a salary level set by the governor.

     (b)  The executive director, without regard to chapters 76 and 89, may retain staff necessary for the purpose of this chapter and may set their salary levels.  The executive director and staff shall be included in any benefit program generally applicable to the officers and employees of the State.

     §   ‑3  General functions, duties, and powers of the state office of capital improvements.  (a)  The state office of capital improvements shall:

     (1)  Oversee the administration, coordination, and development of state capital improvement projects;

     (2)  Formulate policies and administrative procedures for the implementation of capital improvement programming, budgeting, and monitoring;

     (3)  Provide technical assistance and coordination to the departments and programs;

     (4)  Maintain budget and project information for all state departments; and

     (5)  Provide information to the legislature and the public on the progress of capital improvement projects for the bond program and funds remaining from previous projects.

 

     (b)  Notwithstanding any other law to the contrary, if any of the responsibilities or duties of the state office of capital improvements under subsection (a) overlap with the responsibilities or duties of another agency or authority, the state office of capital improvements shall have exclusive jurisdiction and authority over those responsibilities and duties.

     §   ‑4  State capital improvements special fund.  (a)  There is created a state capital improvements special fund, into which shall be transferred       per cent of all state fund appropriations for capital improvements designated for the construction cost element; provided that this transfer shall apply only to capital improvement appropriations that are designated for the construction or renovation of state buildings.  The transfer requirement under this subsection shall not apply to appropriations from the passenger facility charge special fund established by section 261-5.5 and the rental motor vehicle customer facility charge special fund established under section 261-5.6.

     (b)  The state capital improvements special fund shall be used solely for all costs related to the operating and program expenses of the state office of capital improvements, including any consultant or staff services required to carry out duties of the office.

     (c)  The amount to be transferred to the state capital improvements special fund under subsection (a) shall be included in all capital improvement appropriations and shall be calculated at the time the appropriation bills are signed into law.  The moneys shall be transferred into the state capital improvements special fund upon availability of moneys from the appropriations.  Each agency receiving capital improvement appropriations shall calculate the amount to be transferred under subsection (a) and transfer the moneys into the state capital improvements special fund."

     SECTION 3.  There is appropriated out of the state capital improvements special fund of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2010-2011 for the operating and program expenses of the state office of capital improvements.

     The sum appropriated shall be expended by the department of budget and finance for the purposes of this Act.


     SECTION 4.  This Act shall take effect on July 1, 2010.
