A BILL FOR AN ACT

 

 

relating to PUBLIC boards.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 92-15.5, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§92-15.5[]]  Nonattendance of board member; expiration of term.  (a)  Notwithstanding any law to the contrary, the term of a board member shall expire [upon the failure of] if the board member[, without valid excuse,] fails to attend [three] four consecutive meetings duly noticed to all members of the board [and where the board failed to constitute quorum necessary to transact board business.  The chair or acting chair of the board shall determine if the absence of the member is excusable].  Upon the fourth consecutive absence, the chair or acting chair of the board shall provide notice to the board member of the board member's termination.  The expiration of the board member's term shall be effective immediately after the [third] fourth consecutive unattended meeting [and unexcused absence].

     (b)  The chair or acting chair of the board shall immediately notify the applicable nominating authority in writing of any vacancy resulting from termination, resignation, expiration of the term, or any other reason, no later than fifteen days after the vacancy occurs.  The vacancy shall be filled in the same manner as the original appointment.

     [(b)] (c)  This section shall not apply to ex officio members of a board.

     [(c)] (d)  Notwithstanding the definition of "board" in section 92-2, this section shall apply only to a state board and shall not apply to a board of any political subdivision of the State or whose authority is strictly advisory."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Requires a board chair to provide notice to a board member who fails to attend four consecutive duly noticed meetings.  Requires the board chair to provide notice to the board member who accumulates four unexcused absences of the board member's termination.  Requires a board chair to notify in writing the applicable nominating authority of any vacancy resulting from termination, resignation, expiration of the term, or any other reason, within fifteen days after the vacancy occurs.
