A BILL FOR AN ACT

 

 

RELATING TO MEDICAL RECORDS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 622-57, Hawaii Revised Statutes, is amended by amending subsection (g) to read as follows:

     "(g)  Reasonable costs incurred by a health care provider in making copies of medical records shall be borne by the requesting person[.]; provided that health care providers may charge a flat fee of $15.60, or the amount currently approved by the Social Security Administration, whichever amount is greater, to a patient for copies of medical records necessary to support a claim or appeal under any provision of the Social Security Act, title 42 United States Code section 301 et seq.; or may provide such records free of charge to a patient."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.
