A BILL FOR AN ACT

 

 

relating to health.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 436E-4, Hawaii Revised Statutes, is amended to read as follows:

     "§436E-4  Exemptions.  A licensed acupuncturist of another state or country for demonstrations or lectures to be given at acupuncture or medical society meetings or at acupuncture schools shall be exempt from licensing procedures set forth in this chapter.  Any acupuncture practitioner rendering care or psychological first aid in medically underserved communities or public health programs, who has a certificate of completion by the National Acupuncture Detoxification Association or an equivalent training program for administering auricular acupuncture treatment under the general supervision of a licensed physician, osteopath, chiropractor, naturopathic practitioner, acupuncturist, nurse practitioner, or physician's assistant, shall be exempt from the licensing procedures set forth in this chapter; provided that the acupuncture practitioner shall submit the acupuncture practitioner's certificates of completion to the board of acupuncture and to any other applicable board governing the acupuncture practitioner's profession prior to performing auricular acupuncture."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Creates an exemption from the acupuncture licensing procedures for any acupuncture practitioner rendering care or psychological first aid in medically underserved communities or public health programs, who has a certificate of completion by the national acupuncture detoxification association or an equivalent training program, and who operates under the supervision an enumerated list of licensed practitioners.
