A BILL FOR AN ACT
RELATING TO HARBORS.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§200- Keehi boat harbor; Ala Wai boat harbor;
long-term berth leases. (a) Notwithstanding sections 200-2.5 and 200-2.6,
the board may sell the leasehold interest for some or all of the berths at the
Keehi board harbor and Ala Wai boat harbor; provided that the term of leasehold
interest shall not exceed fifty years. The
board shall adopt rules in accordance with chapter 91 to establish slip prices,
which shall be based on slip size.
(b) The fees established pursuant to section
200-10 shall not be assessed on any person mooring a vessel at a berth leased
pursuant to subsection (a); provided that the board may establish and assess maintenance
fees specific to persons mooring vessels at berths leased pursuant to
subsection (a).
(c) Revenues due to the State derived from the sale
of leasehold interests pursuant to subsection (a) shall be deposited into separate
accounts within the boating special fund and shall only be expended on repair and
maintenance and capital improvement projects that benefit the harbors from which
the revenues are derived.
(d) Notwithstanding section 171-53, the prior authorization of the legislature by concurrent resolution shall not be required for the lease of submerged lands and lands beneath tidal waters pursuant to subsection (a).
(e) The department shall adopt rules pursuant to chapter 91 to effectuate this section."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
