A BILL FOR AN ACT


 

 

relating to legislative salaries.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 24-1.5, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§24-1.5[]]  Payment of legislative salaries[.]; waiver.  (a)  The annual salary of any legislator, as determined pursuant to [Article III,] article XVI, section [9,] 3.5, of the Constitution of the State of Hawaii, shall be paid in equal amounts, beginning with the first pay period for state employees in November of the year the legislator is elected.

     (b)  Any member of the legislature who does not wish to receive an increase in salary, as recommended by the commission on salaries, may waive in writing the amount of the recommended salary increase and continue to receive the legislator's prior salary upon certification of the waiver to the house of representatives or senate, as applicable, as provided by rules adopted by the respective body; provided that:

     (1)  The salary increase waiver shall not prohibit any successor legislator from receiving a salary in the amount most recently recommended by the commission on salaries as provided in section 26-56;

     (2)  A legislator who waives a salary increase may subsequently, in writing, rescind the waiver and elect to receive the salary increase recommended by the commission on salaries; provided that the legislator shall not be entitled to retroactive compensation for the amount of the salary increase that the legislator would have received if the legislator had not waived the salary increase; and

     (3)  Average final compensation shall be calculated by the actual salary received by the legislator for retirement purposes."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
