A BILL FOR AN ACT
relating to voter registration.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 11, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§11- Applications for a driver’s license or state identification card. (a) Notwithstanding any law to the contrary, an affidavit on application for voter registration shall be a part of the application associated with the issuance of a civil identification card under section 286-301 and a driver’s license under section 286-109.
(b) Applications for an identification card or driver’s license shall not be processed until the applicant clearly:
(1) Indicates that the applicant declines to register to vote; or
(2) Completes the application for voter registration.
(c) Within five calendar days of the completion of an application for the civil identification card or a driver's license, the examiner of drivers of each county shall provide the voter registration information set forth in the affidavit on application for voter registration, including a digital copy of the applicant's signature, electronically to the respective county clerk.
(d) Upon receipt of a person's voter registration information pursuant to subsection (c), the county clerk shall treat the voter registration as constituting an application to register under section 11-15.
(e) The examiner of drivers for each county shall forward the original copy of any driver's license or civil identification card application, including the affidavit on application for voter registration, to the county clerk.
(f) Databases maintained by the counties and the department of transportation containing driver's license and civil identification card information shall be electronically accessible by the statewide voter registration system, to facilitate the timely processing of voter registration applications that require matching and similar confirmatory checks against those databases."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2015-2016, and the same sum, or so much thereof as may be necessary for fiscal year 2016-2017 for the department of transportation to make necessary changes to its system to permit the electronic transmission, receipt, and processing of voter registration information by the statewide voter registration system and to permit the statewide voter registration system to access driver license and state identification card databases.
The sums appropriated shall be expended by the department of transportation for the purposes of this Act.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2015-2016 and the same sum or so much thereof as may be necessary for fiscal year 2016-2017 to plan, design, and permit the office of elections to make the necessary changes to the statewide voter registration system to permit it to receive and process voter registration transmitted to it electronically by the department of transportation and to permit the statewide voter registration system to access driver license and state identification card databases.
The sums appropriated shall be expended by the office of elections for the purposes of this Act.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2015.
