A BILL FOR AN ACT
Relating to motor vehicle inspections.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that there is little evidence that vehicle safety inspections appreciably decrease motor vehicle accident rates. In 2010, New Jersey joined an increasing number of states that have eliminated vehicle safety inspections. To examine the effects of removing vehicle safety checks, a follow-up study reviewed New Jersey crash data from 2000 to 2015. The study concluded that ending the vehicle safety requirements did not result in a significant increase in the frequency or intensity of accidents. Rather, national studies of crash data indicate that driver error is the overwhelming cause of accidents. One North Carolina review found that vehicle mechanical conditions contributed to only one per cent of crashes statewide.
The legislature further finds that the decreased availability of safety inspectors in Hawaii, compounded by the increasingly limited number of hours offered to the public to receive the services, has caused annual motor vehicle safety inspections to become an undue hardship on Hawaii's residents, particularly residents living in rural areas.
As motor vehicle safety inspections do not significantly improve road safety, annual safety inspections of non-commercial vehicles amount to little more than a regressive tax on vehicle owners. Therefore, the purpose of this Act is to eliminate motor vehicle safety inspections for non-commercial vehicles.
SECTION 2. Section 286-26, Hawaii Revised Statutes, is amended as follows:
1. By amending subsection (b) to read:
"(b) All other vehicles, including motorcycles,
mopeds, trailers, semitrailers, and pole trailers having a gross vehicle weight
rating of 10,000 pounds or less, and antique motor vehicles as defined in
section 249-1, except those in subsections (c) [and], (d), and
(h), shall be certified as provided in subsection (e) every twelve months;
provided that any vehicle to which this subsection applies, except a moped,
shall not require inspection within two years of the date on which the vehicle
was first sold."
2. By amending subsection (h) to read:
"(h) This section shall not apply to:
(1) Any motor vehicle which is covered by part XI, governing safety of motor carrier vehicle operation and equipment; provided that the rules adopted pursuant to part IA impose standards of inspection at least as strict as those imposed under subsection (g) and that certification is required at least as often as provided in subsections (a), (b), (c), and (d);
(2) Aircraft servicing
vehicles that are being used exclusively on lands set aside to the department
of transportation for airport purposes; [and]
(3) Tractor trucks,
forklifts, and top picks being used as
marine terminal equipment temporarily moving in or between terminals at
Sand Island and along Sand Island Parkway and Sand Island Access Road[.];
and
(4) Any non-commercial
vehicle, except as provided in subsection (c)."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
