A BILL FOR AN ACT
relating to care facility inspections.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the department of health is responsible for licensing, certifying, and monitoring several types of care facilities, including adult day health centers, adult day care centers, community care foster family homes, developmental disabilities domiciliary homes, developmentally disabled adult foster homes, long-term care facilities, and special treatment facilities. Although the department of health performs inspections to ensure a standard of quality of these facilities using state monies, the information in the inspection reports is difficult for the public to access. As a result, Act 213, Session Laws of Hawaii 2013, was enacted to require, among other things, the department of health to make available to the public, free of charge, information collected from the department's inspections of certain care facilities occurring on and after January 1, 2015. However, because of a lack of resources and staff, posting of the inspection reports for all of the specified care facilities by the department of health has not been consistent, leaving the public frustrated.
The purpose of this Act is to provide the department of health with additional resources so that the department may continue to make available its care facility inspection reports on the department's website, which would benefit the public by granting greater access to information on the quality and conditions of care facilities in the State.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to enable the department of health to continue to post care facility inspection reports on its website, pursuant to Act 213, Session Laws of Hawaii 2013, including through the hiring of full-time equivalent positions ( .0 FTE).
The sums appropriated shall be expended by the department of health for the purposes of this Act.
SECTION 3. This Act shall take effect on July 1, 2017.
