A BILL FOR AN ACT
relating to planning.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. A goal of the Hawaii state plan, chapter 226, Hawaii Revised Statutes, is to pursue the return of federally controlled lands not required for national defense or other national purposes to the State.
Chapter 225M, Hawaii Revised Statutes, tasks the department of business, economic development, and tourism's office of planning with responsibility for gathering, analyzing, and providing information to the governor to assist in the formulation of state policies in order to provide direction and cohesion for state programs and to address issues and opportunities.
The legislature finds that the return of federal property not needed for national defense or other national purposes is an area of opportunity that should be addressed to promote the economic and social needs of Hawaii's people.
SECTION 2. The department of business, economic development, and tourism's office of planning shall establish a commission to identify and prioritize federal properties that may become surplus at some future date. The commission shall be composed of seven members from relevant state agencies and the public. The commission shall elect a chairperson and vice-chairperson from among its members. A majority of the members of the committee shall constitute a quorum. Members of the commission shall serve without compensation. The commission shall consult with appropriate federal agencies to identify relevant properties. Properties identified shall be prioritized in terms of their potential economic and social benefits to the State.
SECTION 3. The commission shall submit a report of its findings and recommendations to the governor and legislature by December 31, 2009.
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $50,000 or so much thereof as may be necessary for fiscal year 2009-2010 for identification and prioritization of federal properties for possible return to the State.
The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.
SECTION 5. This Act shall take effect upon its approval; provided that section 4 shall take effect on July 1, 2009; and provided further that the Act shall be repealed on June 30, 2010.
