A BILL FOR AN ACT

 

 

relating to the Practice of Law.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 605, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§605-    Law school faculty members.  (a)  A faculty member of the school of law at the University of Hawaii established under section 304A-1351 who has graduated from an accredited law school and been admitted to practice in the highest court of another state or territory of the United States or the District of Columbia shall:

     (1)  Meet all application requirements, character and fitness requirements, and application investigation requirements for admission to practice law in the State;

     (2)  Not be suspended, disbarred, or allowed to practice only under supervision in any other jurisdiction, nor have resigned from practice in any other jurisdiction in lieu of disbarment;

     (3)  Have the opportunity to petition the supreme court for review of any adverse recommendation regarding the faculty member's character and fitness; and

     (4)  Be permitted to apply for pro hac vice status if not admitted to practice law in this State.

     (b)  A faculty member of the school of law at the University of Hawaii may apply for admission to practice law in in this State and obtain a license without examination if all other prerequisites to obtain a license are met by the faculty member.

     (c)  The supreme court may prescribe any additional qualifications for law school faculty members to apply for and obtain a license without examination."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
