A BILL FOR AN ACT

 

 

RELATING TO THE DEPARTMENT OF EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Fundraising and charitable activities; school projects.  Notwithstanding any law to the contrary, nothing shall prohibit a school or class from participating in fundraising or charitable activities in conjunction with an organization that is exempt from federal taxes under section 501(c)(3) of the Internal Revenue Code of 1986, as amended, and registered under section 467B-2.1 or granted an exception from registration under section 467B-11.5, as part of a school project when the fundraising or charitable activities benefit student learning.  Pursuant to chapter 91, the department shall adopt reasonable, objective criteria for the selection of fundraising or charitable activities to ensure that such activities benefit student learning.  The criteria shall strictly prohibit coercing or pressuring students or their families to participate in fundraising activities."

     SECTION 2.  New statutory material is underscored.   SECTION 3.  This Act shall take effect on July 1, 2015.

Description:

Bars prohibition of student or class participation in a fundraiser or charitable activity in conjunction with a nonprofit organization as part of a school project when participation benefits student learning.  Requires the department of education to adopt reasonable objective criteria for the selection of fundraising activities and to include a strict prohibition against coercion or pressuring students or their families to participate in the fundraising activities.  (SD1)
