A BILL FOR AN ACT
relating to motor vehicles.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 286-28, Hawaii Revised Statutes, is amended to read as follows:
"§286-28 Suspension or revocation of permits. (a) The department shall supervise and cause inspections to be made of official inspection stations and shall suspend or revoke and require the surrender of the permit issued to a station which it finds is not properly conducting inspections. The department shall maintain and post at its office lists of all stations holding permits and those whose permits have been suspended or revoked.
(b) If an official inspection station grants a certificate of inspection to a motorcycle that is in violation of section 291-24, the owner of the official inspection station shall be penalized as follows:
(1) For a first offense, by an administrative fine of $3,000, imprisonment of five days, and a six month suspension of an official inspection permit;
(2) For a second offense, by an administrative fine of $10,000, imprisonment of one year, and a one year suspension of an official inspection permit; and
(3) For a third or subsequent offense, by an administrative fine of $100,000, imprisonment of one year, and permanent ban of an official inspection permit. In addition, all property and equipment involved in a violation of this subsection shall be subject to seizure and forfeiture pursuant to chapter 712A."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
