SENATE CONCURRENT
RESOLUTION
REQUESTING THE DEPARTMENT OF LAND AND NATURAL RESOURCES DIVISION OF BOATING AND OCEAN RECREATION AND COUNTY OF HAWAII TO WORK TOGETHER TO IDENTIFY AND PURSUE THE BEST PLAN OF ACTION TO ADDRESS ISSUES AT KAHALU‘U BEACH PARK ON HAWAII ISLAND.
WHEREAS, the Department of Land and Natural Resources Division of Boating and Ocean Recreation aims to preserve the State's natural and cultural resources while ensuring public access to state waters and enhancing the ocean experience; and
WHEREAS, one of the Division of Boating and Ocean Recreation's goals is to generate revenue in support of the Division's programs, operations, and maintenance; and
WHEREAS, the Division of Boating and Ocean Recreation issues commercial use permits for activity in state ocean waters, among other revocable permits; and
WHEREAS, the County of Hawai‘i manages the beach and shoreline at Kahalu‘u Beach Park in North Kona, Hawai‘i island, which has gray sand and a rocky shoreline; and
WHEREAS, commercial activity on the beach and shoreline at Kahalu‘u Beach Park requires a permit from the County of Hawai‘i Department of Parks and Recreation; and
WHEREAS, commercial activity in state waters near Kahalu‘u Beach Park requires a permit from the Division of Boating and Ocean Recreation; and
WHEREAS, the processes for issuing commercial use permits for state waters and the beach and shoreline at Kahalu‘u Beach Park are incongruent and could be streamlined to be more efficient; and
WHEREAS, cooperation between the Division of Boating and Ocean Recreation and the County of Hawai‘i can help improve and streamline the state waters and beach and shoreline commercial use permit processes for Kahalu‘u Beach Park; now, therefore,
BE IT RESOLVED by the Senate of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, the House of Representatives concurring, that the Division of Boating and Ocean Recreation and County of Hawai‘i are requested to collaborate to identify and pursue the best plan of action moving forward, given adjacent jurisdictions of the County and State at Kahalu‘u Bay, to meet county and state interests in supporting a balanced solution for community and business to address issues of overcrowding and safety; improving, identifying, and protecting native Hawaiian rights and customary and traditional practices; and streamlining the state waters and beach and shoreline commercial use permit processes for Kahalu‘u Beach Park; and
BE IT FURTHER RESOLVED that the Division of Boating and Ocean Recreation and County of Hawai‘i are requested to submit a report of their progress and recommendations, including any proposed legislation, regarding the plan of action to the Legislature no later than twenty days prior to the convening of the Regular Session of 2020; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources, Administrator of the Division of Boating and Ocean Recreation of the Department of Land and Natural Resources, and Mayor of the County of Hawai‘i.
