SENATE CONCURRENT

RESOLUTION

 

 

requesting the department of transportation to ensure that any person it hires or causes to be hired, including private security guards, to provide armed security services at airports presents proof of proper education, experience, training, and credentials as determined by the sheriff division.

 

 


     WHEREAS, the Department of Transportation is responsible for the security of the State's airports under section 261-2, Hawaii Revised Statutes, which provides in pertinent part, "[t]he department of transportation shall have general supervision over aeronautics within the State"; and

 

     WHEREAS, section 261-12, Hawaii Revised Statutes, further provides in pertinent part that the Director of Transportation is empowered to act "for the purpose of protecting and insuring the general public interest and safety, the safety of persons operating, using, or traveling in aircraft, and the safety of persons and property on land or water"; and

 

     WHEREAS, in addition to the deputy sheriffs, the Department of Transportation contracts with private security firms to provide airport security; and

 

     WHEREAS, concerns have been raised about the qualifications of private security guards providing airport security; and

 

     WHEREAS, there is concern regarding whether private security guards at the State's airports, who carry guns and have the authority to arrest people, are qualified and properly trained to do so; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2016, the House of Representatives concurring, that the Department of Transportation is requested to ensure that any person it hires or causes to be hired, including private security guards, to provide armed security services at airports presents proof of proper education, experience, training, and credentials as determined by the sheriff division; and

 

     BE IT FURTHER RESOLVED that in conferring police powers upon designated employees, agents, and representatives of the Department, the Director of Transportation is requested to provide written notice in advance of the effective date of the designation to the President of the Senate, Speaker of the House of Representatives, and Attorney General, including a summary of the plan to be implemented in connection with the designation; and

 

     BE IT FURTHER RESOLVED that the Director of Transportation is requested to report annually to the Legislature, no later than January 10 of each calendar year, the number of individuals conferred police powers in the immediate preceding calendar year, the location where these individuals work, and the number of individuals having police powers who continue to work in that capacity at the end of that calendar year; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation and Deputy Director of Law Enforcement of the Department of Public Safety.
