SENATE RESOLUTION
URGING THE GOVERNOR TO NOT TRANSFER HAPUNA BEACH AND MAUNA KEA STATE RECREATION AREAS FROM THE STATE OF HAWAII TO THE COUNTY OF HAWAII.
WHEREAS, chapter 184, Hawaii Revised Statutes, places the operations, maintenance, and improvement of state parks within the purview of the Department of Land and Natural Resources, which has the ability, resources, and expertise to perform these tasks; and
WHEREAS, although the County of Hawaii has previously indicated its willingness to assume responsibility for the operation, maintenance, and improvement of certain parks on the Island of Hawaii, the County of Hawaii faces difficulties that limit its ability to support additional responsibilities at this time; and
WHEREAS, the Governor and the Mayor of the County of Hawaii have entered into a written agreement authorizing the Governor to transfer the estate, title to, right to, interest in, and any appurtenance of the Hapuna Beach and Mauna Kea State Recreation Areas from the State of Hawaii to the County of Hawaii; and
WHEREAS, residents of and visitors to the State of Hawaii use the public facilities located within Hapuna Beach and Mauna Kea State Recreation Areas, including restrooms, shelters, and picnicking areas, and the return of many of these visitors depends on the quality of their experience at the state recreation areas; and
WHEREAS, Senate Bill No. 1555 was introduced during the 2011 Regular Session proposing a new chapter to be added to the Hawaii Revised Statutes that creates a Public Land Development Corporation within the Department of Land and Natural Resources to broaden the Department's mission to enable it to develop and manage revenue-generating recreational and leisure centers throughout the State; and
WHEREAS, Hapuna Beach and Mauna Kea State Recreation Areas have the potential to be sources of revenue generation for the State through the implementation of user fees and public-private partnerships, especially if the proposed Public Land Development Corporation is established; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, that the Governor is urged to not transfer Hapuna Beach and Mauna Kea State Recreation Areas from the State of Hawaii to the County of Hawaii; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Governor, Mayor of the County of Hawaii, Chairperson of the Hawaii County Council, and Chairperson of the Board of Land and Natural Resources.
