SENATE RESOLUTION
requesting the auditor to conduct a sunrise review of the licensure and regulation of third-party review services providers.
WHEREAS, a third-party review services provider is an entity that provides comprehensive third-party plan review services of a residential, commercial, or industrial development project's proposed plans, specifications, and permit applications to ensure compliance with applicable building, electrical, structural, plumbing, mechanical, residential, and residential land use laws, rules, ordinances, and codes; and
WHEREAS, the State's housing costs, including the costs associated with developing land and building homes, are increasing; and
WHEREAS, these increases are partially due to the lengthy review processes required for proposals and permit applications; and
WHEREAS, because the counties lack sufficient qualified staffing to conduct these reviews, homeowners, property owners, and developers are increasingly using third-party review service providers; and
WHEREAS, regulating third-party review services is necessary to protect consumers, reduce the occurrence of non‑compliant construction plans, and increase the efficiency and timeliness of the overall review process; and
WHEREAS, it is appropriate for the Auditor to conduct a sunrise review of the third-party review services profession prior to the State enacting regulatory legislation; now, therefore,
BE IT RESOLVED by the Senate of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2022, that the Auditor is requested to conduct a sunrise review of the licensure and regulation of third-party review services providers as established in legislation introduced during the 2022 Regular Session; and
BE IT FURTHER RESOLVED that the Auditor is requested to submit a report of the Auditor's findings to the Legislature no later than twenty days prior to the Regular Session of 2023; and
BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Auditor.
