SENATE RESOLUTION
URGING THE HAWAII CONGRESSIONAL DELEGATION
AND STATE OFFICIALS TO SUPPORT THE MARIJUANA IN FEDERALLY ASSISTED HOUSING
PARITY ACT OF 2021 AND REQUESTING ASSISTANCE FROM THE DRUG ENFORCEMENT
ADMINISTRATION TO RESOLVE THE CONFLICT BETWEEN THE FEDERAL REGULATION OF MARIJUANA
AND STATE-AUTHORIZED USE OF CANNABIS IN HAWAII.
WHEREAS, the ongoing conflict between state and federal regulation of cannabis is causing devastating consequences for the State's lawfully registered medical cannabis patients, even resulting in evictions from federally subsidized housing; and
WHEREAS, the Legislature addressed this conflict during the Regular Session of 2021 by unanimously adopting House Concurrent Resolution 132, H.D. 1, S.D. 1 (H.C.R. No. 132), which asks the Department of Health to apply to the Drug Enforcement Administration for an exemption to certain federal regulations for the state-authorized use of cannabis in Hawaii; and
WHEREAS, the Legislature has received no response from the Department of Health; and
WHEREAS, United States Congresswoman for the District of Columbia Eleanor Holmes Norton is the sponsor of the Marijuana in Federally Assisted Housing Parity Act of 2021 (H.R. No. 3212) in the United States Congress; and
WHEREAS, H.R. No. 3212 would permit the use of marijuana in federally assisted housing in compliance with the marijuana laws of the applicable state where the property is located; and
WHEREAS, under H.R. No. 3212, the U.S. Department of Housing and Urban Development (HUD) would be required to develop regulations that restrict the smoking of marijuana in federally assisted housing in the same manner and in the same locations as HUD restricts the smoking of tobacco in federally assisted housing; and
WHEREAS, on November 9, 2021, Congresswoman Norton issued a press release expressing her disappointment in HUD's rejection of her request to allow marijuana use in public housing in jurisdictions where it is legal and urged Congress to pass H.R. No. 3212; now, therefore,
BE IT RESOLVED by the Senate of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2022, that the members of Hawaii's Congressional Delegation, Governor, Attorney General, Hawaii Department of Health, and Hawaii housing agencies are urged to support the passage of H.R. No. 3212, the Marijuana in Federally Assisted Housing Parity Act of 2021 ; and
BE IT FURTHER RESOLVED that the Drug Enforcement Administration is requested to assist with resolving the ongoing conflict between the federal regulation of marijuana and the state-authorized use of cannabis in Hawaii; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to Congresswoman Eleanor Holmes Norton, members of Hawaii's Congressional Delegation, Administrator of the Drug Enforcement Administration, Governor, Attorney General, Hawaii Director of Health, Executive Director of the Hawaii Public Housing Authority, and Executive Director of the Hawaii Housing and Finance Development Corporation.
