RULES.
The
2
department
of
human
services
shall
adopt
rules
pursuant
to
3
chapter
17A
to
provide
the
following
with
regard
to
resolution
4
of
cost
reports
and
rate
setting
for
home
and
community-based
5
services
providers
under
the
Medicaid
program:

1.
A
request
by
the
department
for
additional
information
7
from
a
provider
following
submission
of
the
provider’s
cost
8
report
shall
not
affect
the
total
number
of
days
specified
in
9
the
provider
contract
for
resolution
of
cost
reports.
Upon
10
receipt
of
the
additional
information,
the
department
shall
11
restart
the
resolution
period
beginning
with
the
day
after
the
12
number
of
days
elapsed
prior
to
the
request
for
additional
13
information,
and
shall
resolve
the
cost
report
within
the
time
14
that
remains
in
the
resolution
period
specified
in
the
provider
15
contract.

2.
Notwithstanding
resolution
of
a
provider’s
cost
report,
17
a
provider’s
new
rate
shall
be
effective
the
day
after
the
18
day
that
constitutes
the
end
of
the
time
period
specified
for
19
resolution
of
cost
reports
in
the
provider
contract.

EXPLANATION
21
This
bill
relates
to
cost
report
and
rate
setting
provisions
22
for
Medicaid
program
home
and
community-based
services
23
providers.
The
bill
directs
the
department
of
human
services
24
(DHS)
to
adopt
administrative
rules
to
provide
that
once
a
25
provider’s
cost
report
is
submitted,
a
request
for
additional
26
information
by
DHS
shall
not
affect
the
time
frame
specified
27
in
the
provider’s
contract
for
resolution
of
cost
reports.

Additionally,
the
rules
are
to
provide
that
upon
receipt
of
29
the
additional
information
by
DHS,
DHS
is
required
to
restart
30
the
resolution
period
the
day
after
the
number
of
days
elapsed
31
prior
to
the
request
for
additional
information,
and
resolve
32
the
cost
report
within
the
time
that
remains
in
the
resolution
33
period
specified
in
the
provider
contract.

With
regard
to
rate
setting,
the
bill
directs
DHS
that
