H.F. 106 Section 1. NEW SECTION . 16.50A Mobile home park improvement 1 assistance fund. 2 1. As used in this section, unless the context otherwise 3 requires: 4 a. “Fund” means the mobile home park improvement assistance 5 fund. 6 b. “Manufactured home” means a factory-built structure built 7 under authority of 42 U.S.C. §5403, that is required by federal 8 law to display a seal from the United States department of 9 housing and urban development, and that was constructed on or 10 after June 15, 1976. 11 c. “Mobile home” means any vehicle without motive power 12 used or so manufactured or constructed as to permit its being 13 used as a conveyance upon the public streets and highways and 14 so designed, constructed, or reconstructed as will permit the 15 vehicle to be used as a place for human habitation by one or 16 more persons; but shall also include any such vehicle with 17 motive power not registered as a motor vehicle in Iowa. 18 d. “Mobile home park” means a site, lot, field, or tract 19 of land upon which three or more mobile homes or manufactured 20 homes, or a combination of any of these homes, are placed on 21 developed spaces and operated as a for-profit enterprise with 22 water, sewer or septic, and electrical services available. 23 The term “mobile home park” shall not be construed to 24 include manufactured or mobile homes, buildings, tents, or 25 other structures temporarily maintained by any individual, 26 educational institution, or company on their own premises and 27 used exclusively to house their own labor force or students. 28 e. “Mobile home space” means a parcel of land for rent which 29 has been designed to accommodate a mobile home and provide the 30 required sewer and utility connections. 31 f. “Tenant” means a person entitled under a rental agreement 32 to occupy a mobile home space to the exclusion of others. 33 2. a. A mobile home park improvement assistance fund 34 is created within the authority, and the authority shall 35 -1- LSB 1159YH (2) 90 ko/jh 1/ 3
H.F. 106 administer the fund in a manner to provide technical and 1 financial assistance to cities, counties, and nonprofit 2 entities for the acquisition and initial improvement of mobile 3 home parks, located within the city or county, in which the 4 majority of tenants are low or moderate income and are at risk 5 of displacement. 6 b. The fund may consist of any moneys appropriated by the 7 general assembly for purposes of this section and any other 8 moneys that are lawfully available to the authority. The 9 authority shall use any moneys specifically appropriated for 10 purposes of this section only for the purposes of this section. 11 The authority may use all other moneys in the fund, including 12 interest, earnings, and recaptures, for purposes of this 13 section. 14 c. The executive director of the authority may transfer 15 any unobligated and unencumbered moneys in any fund created 16 pursuant to section 16.5, subsection 1, paragraph “s” , for 17 deposit in the fund. 18 d. If the moneys available under paragraphs “b” and “c” 19 are insufficient to provide technical and financial assistance 20 under paragraph “a” , the executive council may authorize 21 payment of moneys as an expense paid from the appropriations 22 addressed in section 7D.29 in an amount necessary to support 23 the fund. 24 e. Notwithstanding section 8.33, moneys in the fund at the 25 end of each fiscal year shall not revert to the general fund or 26 any other fund but shall remain in the fund for expenditure for 27 subsequent fiscal years. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill relates to technical and financial assistance 32 provided by the Iowa finance authority (authority) to cities, 33 counties, and nonprofit entities for the acquisition and 34 improvement of certain mobile home parks. 35 -2- LSB 1159YH (2) 90 ko/jh 2/ 3
H.F. 106 The bill creates a mobile home park improvement assistance 1 fund (fund) within the authority, and the authority shall 2 administer the fund in a manner to provide technical and 3 financial assistance to cities, counties, and nonprofit 4 entities for the acquisition and initial improvement of mobile 5 home parks, located within the city or county, in which the 6 majority of tenants are low or moderate income and are at risk 7 of displacement. “Mobile home park” and “tenant” are defined 8 in the bill. 9 The fund may consist of any moneys appropriated by the 10 general assembly and any other moneys lawfully available to 11 the authority. The executive director of the authority may 12 transfer any unobligated and unencumbered moneys in any fund 13 created pursuant to Code section 16.5(1)(s) for deposit in the 14 fund.
