1.
MEDICAID
DEMONSTRATION
WAIVER

SUBSTANCE
USE

DISORDER
TREATMENT.
The
department
of
human
services
shall
2
submit
a
Medicaid
1115
demonstration
waiver
application
to
3
the
centers
for
Medicare
and
Medicaid
services
of
the
United
4
States
department
of
health
and
human
services,
in
accordance
5
with
the
initiative
described
in
state
Medicaid
director
6
letter
#17-003
relating
to
strategies
to
address
the
opioid
7
epidemic,
to
support
the
delivery
of
a
full
continuum
of
8
comprehensive,
evidence-based
substance
use
disorder
treatment
9
services
to
Medicaid
members
in
an
effort
to
improve
quality,
10
accessibility,
and
outcomes
in
the
most
cost-effective
manner,
11
including
by
accessing
federal
financial
participation
for
12
clinically
appropriate
services
otherwise
approved
under
13
the
Iowa
Medicaid
state
plan
delivered
to
individuals
with
14
substance
use
disorders
in
institutions
for
mental
disease
as
15
defined
in
42
U.S.C.
§1396d(i).
The
department
shall
provide
16
progress
reports
regarding
the
approval
of
the
demonstration
17
waiver
application
to
the
governor
and
the
general
assembly
on
18
a
quarterly
basis.

EXPLANATION
20
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
21
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
department
of
human
services
(DHS)
23
to
submit
a
Medicaid
1115
demonstration
waiver
application
to
24
the
centers
for
Medicare
and
Medicaid
services
of
the
United
25
States
department
of
health
and
human
services,
in
accordance
26
with
federal
guidance
relating
to
strategies
to
address
the
27
opioid
epidemic,
to
support
the
delivery
of
a
full
continuum
of
28
comprehensive,
evidence-based
substance
use
disorder
treatment
29
services
to
Medicaid
members
in
an
effort
to
improve
quality,
30
accessibility,
and
outcomes
in
the
most
cost-effective
manner.

The
demonstration
waiver
would,
in
part,
allow
the
state
32
to
receive
federal
financial
participation
for
clinically
33
appropriate
Medicaid
services
delivered
to
individuals
with
34
substance
use
disorders
in
institutions
for
mental
disease

(IMD).
Currently,
federal
financial
participation
is
not
1
available
for
such
services
delivered
in
an
IMD,
which
under
2
federal
law
is
defined
as
a
hospital,
nursing
facility,
or
3
other
institution
of
more
than
16
beds,
that
is
primarily
4
engaged
in
providing
diagnosis,
treatment,
or
care
of
persons
5
with
mental
diseases,
including
medical
attention,
nursing
6
care,
and
related
services.
DHS
shall
provide
progress
reports
7
regarding
the
approval
of
the
demonstration
waiver
application
8
to
the
governor
and
the
general
assembly
on
a
quarterly
basis.
