Section 709.21, subsection 3, Code 2015, is 1 2 amended to read as follows: 1 3 3. A person who violates this section commitsa seriousan 1 4 aggravated misdemeanor. 1 5 EXPLANATION 1 6 The inclusion of this explanation does not constitute agreement with 1 7 the explanation's substance by the members of the general assembly. 1 8 This bill increases the penalty for the crime of invasion of 1 9 privacy. 1 10 Under Code section 709.21, a person commits invasion of 1 11 privacy if the person knowingly views, photographs, or films 1 12 another person for the purpose of arousing or gratifying the 1 13 sexual desire of any person, and the other person does not have 1 14 knowledge about and does not consent or is unable to consent to 1 15 being viewed, photographed, or filmed, is in a state of full 1 16 or partial nudity, and has a reasonable expectation of privacy 1 17 while in a state of full or partial nudity. 1 18 Under current law, a person who commits invasion of privacy 1 19 commits a serious misdemeanor. Under Code section 903.1, a 1 20 person who commits a serious misdemeanor shall be fined between 1 21 $315 and $1,625 and may be imprisoned for a period to exceed 1 22 one year. 1 23 The bill amends current law to provide that a person who 1 24 commits invasion of privacy commits an aggravated misdemeanor. 1 25 Under Code section 903.1, a person who commits an aggravated 1 26 misdemeanor shall be fined between $625 and $6,250 and shall be 1 27 imprisoned for a period not to exceed two years.
