H.F. 187 Section 1. Section 257.11B, subsection 2, paragraph a, 1 subparagraph (2), unnumbered paragraph 1, Code 2025, is amended 2 to read as follows: 3 For the school budget year years beginning on or after July 4 1, 2024, the following pupils who attend a nonpublic school 5 for that school budget year shall be eligible to receive an 6 education savings account payment: 7 Sec. 2. Section 257.11B, subsection 2, paragraph a, 8 subparagraph (3), Code 2025, is amended by striking the 9 subparagraph. 10 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 11 importance, takes effect upon enactment. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill modifies provisions related to eligibility for 16 payments under the education savings account program. 17 Under current law, for the school budget year beginning July 18 1, 2024, the following pupils who attend a nonpublic school are 19 eligible to receive an education savings account payment under 20 Code section 257.11B (education savings account program): a 21 resident pupil who is eligible to enroll in kindergarten, a 22 resident pupil who is eligible to enroll in grades 1 through 12 23 and was not enrolled in a nonpublic school for the school year 24 immediately preceding the school year for which the education 25 savings account payment is requested, a resident pupil who is 26 eligible to enroll in grades 1 through 12 and was enrolled in 27 a nonpublic school for the school year immediately preceding 28 the school year for which the education savings account 29 payment is requested if the pupil’s household has an annual 30 income less than or equal to 400 percent of the most recently 31 revised poverty income guidelines published by the United 32 States department of health and human services, and a resident 33 pupil who received an education savings account payment in 34 the immediately preceding school budget year. H.F. 187 current law, for school budget years beginning on or after July 1 1, 2025, the eligibility requirement related to the pupil’s 2 household income is removed and resident pupils eligible to 3 enroll in kindergarten through grade 12 who attend a nonpublic 4 school for the applicable school budget year are eligible 5 to receive an education savings account payment. The bill 6 strikes this provision. The bill provides that the eligibility 7 requirement related to the pupil’s household income applies to 8 school budget years beginning on or after July 1, 2024. 9 The bill takes effect upon enactment. 10 -2- LSB 1888YH (2) 91 jda/jh 2/ 2
